  • When served with a foreclosure or consumer law case, seek legal counsel immediately!
  • The law places a high standard for lenders to meet before they can force a debtor out of their house.
  • In many cases lenders have not met these high legal bars, or failed to fully inform their clients about their rights and options both under the law and pertaining to their own contracts.
  • In many cases there are rights and options available to borrowers to help prevent the loss of their property.
  • Once filed, a foreclosure remains in public record even after a bankruptcy is filed, leaving a permanent stain on a consumer's credit.
  • Even if a house is “given back” to the lender or reclaimed through the Courts, the consumer runs the risk of still owing the lender large amounts of money through a deficiency.
  • Schedule your free initial consultation for your foreclosure cases.
  • Bring to your initial consultation the court papers you received and any other documents in your possession regarding the loans on the house. This allows me to see if the lender has filed a valid foreclosure and what options you have available.

Always remember the following:
  • Once you are served with a complaint you have 20 calendar days to formally respond in writing to the Court.
  • A bank can obtain service by publication in the local newspaper, so avoiding service is not an answer.
  • Simply demanding a bank to produce a note may not stop a foreclosure.
  • Many foreclosure defenses do not rely on your ability to pay the mortgage.
  • The attempts to renegotiate a loan do not stop foreclosure proceedings in court.
  • Even if the bank obtains the house through foreclosure you could still have civil obligations and owe money.
